By accessing, browsing, using www.cellularprime.in or any other website, mobile version of the website, or mobile application (together referred to as the “Website”) or availing any of the products of Eskag Pharma Private Limited (hereinafter referred to as “Company,” “We,” “Us,” “Our,” “Brand”) you, including the persons who browse or the persons who order the product, agree to be bound by all of the T&C mentioned hereunder.

Eskag Pharma Private Limited is licensed to use and operate the site and supply products directly to customers who transact using the site. As a user of the site and its services, you are contracting with Eskag Pharma Private Limited through these terms. 

1. Eligibility 

Only persons who can enter into a legally binding contract under the Indian Contract Act, 1872 can use the Website and/or transact on the Website. Any minor who wishes to use or access the Website is required to conduct such transactions through their legal guardian or parents. If you represent a company, partnership firm, or sole proprietorship, you shall be eligible to access and use the Website to conduct the transactions on its behalf only if you have been duly authorized by way of necessary corporate action, as may be prescribed statutorily and/or under the charter documents of such an entity. 

2. Acceptance of Terms and Conditions 

The Company reserves the right to amend or revise the T&C at any time by uploading a revised or amended T&C on the Website with or without prior notice. The amended T&C will be effective immediately after it is uploaded on this Website. Your access or use of the Website following any such changes constitutes your acceptance of the updated T&C, and you shall be bound by these T&C as amended. The version of the T&C that will apply to your order will be those uploaded on the Website at the time you use or access or place your order. For this reason, we encourage you to review these T&C each time you access and place your order. If you do not agree to this T&C (including any referenced policies or guidelines), please immediately terminate your use of the Website. 

3. Product Usage and Medical Disclaimer 

Product Use 
This supplement is intended for use by adults above 18 years of age unless prescribed by a healthcare professional. It is not a substitute for a varied diet and a healthy lifestyle. 

Dosage 
Do not exceed the recommended dosage unless advised by a qualified healthcare professional. 

Storage 
Store the product in a cool, dry place, away from direct sunlight and moisture. Keep out of reach of children.

4. Refund Policy 

Zero Refunds for Unused, Unopened, or Undamaged Products
No refunds shall be issued for products that are not damaged or if the product has been opened, consumed, or used in any manner. It is the customer’s responsibility to ensure that the product remains in its original, unopened, and unused condition if requesting a refund. 

Refunds Only for Physically Damaged Products
Refunds shall be provided solely if the product exhibits physical damage. The customer must initiate a refund request within 2 days from the date of delivery. Upon receipt of the request, the Company will process the refund after thorough verification and approval. If the claim is approved, the refund will be issued within 7 working days from the date of approval. 

Refund Processing Procedure 

In the event a refund request is raised for a physically damaged product, the Customer shall initiate the request by writing to the Company’s designated customer support email within the stipulated timeline, along with clear photographic evidence of the physical damage and relevant order details. 

Upon receipt of the refund request, the Company shall conduct a verification process, which may include review of images, delivery records, and, where required, reverse pickup and physical inspection of the product. Only upon successful verification and internal approval shall the refund be sanctioned. 

Approved refunds shall be processed through the original mode of payment used at the time of purchase. For prepaid orders, the refund shall be credited back to the original payment source. For Cash on Delivery orders, the refund shall be processed via bank transfer to the customer’s provided bank account details. 

The refund shall be completed within seven (7) working days from the date of approval, subject to standard banking timelines. The Company shall not be responsible for delays caused by banks, payment gateways, or third-party service providers beyond its reasonable control. 

5. Delivery and Shipping 

We offer free delivery across India for all pin codes accepted by Delhivery.com. Please note that delivery may not be available in certain remote or restricted areas. You can check if your pin code is serviceable by Delhivery at the time of placing the order. 

6. Third-Party Terms and Conditions 

By using third-party services, such as payment gateways, delivery services, and advertisement platforms, you agree to abide by the terms and conditions of those third parties:

  • Delivery: We use Delhivery for shipping and delivery of products. Delhivery T&C: https://www.delhivery.com/terms-and-conditions

  • Reviews: We use Judge.me and Google for collecting and displaying product reviews. Judge.me: https://judge.me/terms 

The Website at all times adheres to Google’s Terms and Conditions for the use of its services. 

7. Proprietary Rights 

All the brand names owned and licensed to the Company are the exclusive property of the Company, its affiliates, partners, or licensors, and are protected by the laws of India, including laws governing all applicable forms of intellectual property. The Company holds proprietary rights and trade secrets in the Products. You shall not copy, reproduce, modify, duplicate, re-publish, re-sell or redistribute any Product manufactured and/or distributed by the Company in whole or in part or in any other form whatsoever. 

8. Site Security 

You are prohibited from violating or attempting to violate the security of the Website, including, without limitation: 

  • Accessing data not intended for you. 
  • Attempting to probe, scan, or test the vulnerability of a system or network. 
  • Attempting to interfere with service to any other user, host, or network. 
  • Sending unsolicited email, including promotions and advertising of products or services. 
  • Forging any header or part of the header information in any email or newsgroup posting. 
  • Violations of system or network security may result in civil or criminal liability. 

9. Limitation of Liability 

The Company takes no liability for any breach of this T&C or for any damages or loss arising from your use or inability to use the Website or Products, including any damages resulting from (a) the use or inability to use the Website content or Products; (b) the cost of procuring substitute Products or content; (c) any Products purchased or obtained or transactions entered into through the Website; or (d) any lost profits. 

10. Governing Law and Jurisdiction 

This T&C shall be governed by and construed in accordance with the laws of India and will be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India.
